Terms of Service

Effective date: October 2026

These Terms of Service ("Terms") are an agreement between you and Miguel Guizar, doing business as AZ AI Geeks ("AZ AI Geeks," "we," "us," or "our"). They cover your use of azaigeeks.com, our sample and demo sites, and related pages (the "Site"), and they set the general rules for buying our services. Our Refund & Cancellation Policy and Privacy Policy are part of these Terms.

Please read the "Disputes" section. It includes a waiver of jury trial and of class actions.

By using the Site or buying from us, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

AZ AI Geeks is an Arizona business that builds websites, sets up AI Receptionists and booking calendars, and manages paid advertising for small and midsize businesses. You can reach us at hello@azaigeeks.com or (480) 418-2646.

2. Who can use the Site and buy services

Our Site and services are for businesses and people at least 18 years old. If you buy for a company, you confirm you are authorized to act for it, and "you" includes that company.

3. Packages and pricing

  • Starter Website: $497 setup + $129 per month on a 12-month agreement (promotional price offered through November 20, 2026).
  • Growth Engine: $1,050 setup + $300 per month, month-to-month.
  • Full Domination: $10,000 setup + $600 per month for ongoing maintenance, month-to-month.
  • $100 priority deposit: moves you to the front of the current month's build queue and is credited in full toward your setup fee.

Package descriptions on the Site are summaries. Before you pay, we give you an Order Form (and, for most projects, our Client Service Agreement) that lists exactly what you are buying and every cost. If a signed Order Form or Client Service Agreement conflicts with these Terms, the signed document controls for that purchase.

  • Prices are in U.S. dollars and may change for new purchases. The price in your Order Form controls. We may correct obvious pricing errors before you pay.
  • Not included unless your Order Form says so: advertising spend (paid directly to Google, Meta, or other platforms), domain registration, premium software, stock media, telephony or text-message usage above normal levels, and any applicable taxes.
  • Quotes are valid for 30 days unless they say otherwise.

4. Payments, recurring billing, and renewal

  • Payment processing. Payments are processed by Stripe. Your card details go directly to Stripe, and we do not store full card numbers. Stripe's own terms and privacy policy also apply to your payment.
  • Charges at sign-up. When you sign up through our checkout, we charge your setup fee (or, if you choose it, the $100 priority deposit) right away. Stripe securely saves your card so we can make the later charges described below. If you paid the deposit, we charge the rest of your setup fee to the same card after your kickoff call and before we start your build, and we will email you before we do.
  • Authorization for future charges. By completing checkout, you authorize AZ AI Geeks to charge the card you used, or any card you later give us, for: (a) any setup fee balance described above; and (b) the monthly fee for your plan, starting on the date your website or service launches and then on the same day each month, until your plan ends or you cancel as described in these Terms. We will email you to confirm your launch date before the first monthly charge, and we will email a receipt after each charge. Your plan is the one you buy at checkout or, if you paid only the deposit, the one you confirm in writing (such as on your Order Form) before your kickoff call. We will not charge any setup fee balance or monthly fee until your plan is confirmed. The monthly amount is the price listed for your plan when you buy or confirm it, unless we change it as described under Price changes below.
  • Updating or stopping charges. To update your card or cancel, email hello@azaigeeks.com. If a charge fails, we will let you know and may retry it or, as described under Late payments below, pause services. Cancelling stops future monthly charges but does not cancel amounts already owed.
  • Growth Engine and Full Domination are month-to-month and renew automatically each month until you cancel.
  • Starter Website 12-month commitment. The Starter Website is a 12-month agreement starting on your website's launch date, at $129 per month for those 12 months. After 12 months, it continues month-to-month at the same price unless you cancel. We will email you a reminder about 30 days before your 12 months end. You may end the agreement early by paying the early termination amount in our Refund & Cancellation Policy.
  • Cancelling. Email hello@azaigeeks.com. Cancel at least 7 days before your next billing date to avoid the next charge. There are no partial-month refunds. Full details are in our Refund & Cancellation Policy.
  • Price changes. We will give at least 30 days' notice by email before changing a monthly price, and you can cancel before the change takes effect. The Starter Website price is locked at $129 per month for its first 12 months, so any Starter price change can only take effect after those 12 months.
  • Late payments. If a payment fails or is more than 15 days late, we may pause services after giving you 5 days' notice by email. Guarantee time periods stop running while services are paused for non-payment and pick up again once you are paid up.

5. Guarantees and refunds

We offer three guarantees: the Booked Calls Guarantee, Do-It-Again-Free, and the Setup Fee Refund. Their full terms, including what counts, the conditions, and how to claim, are in our Refund & Cancellation Policy. Those guarantees are the only performance promises we make.

6. Your responsibilities as a client

  • Give us the content, logins, phone and calendar access, and approvals we need, promptly. Deadlines and guarantees extend day for day while we are waiting on you.
  • Make sure the content you give us is accurate and that you have the right to use it.
  • If you use our AI Receptionist, play the greeting we set up telling callers they are speaking with an AI assistant and that the call may be recorded and transcribed, and get any consent the law requires for calls and texts to your customers.
  • Do not use our AI Receptionist to collect health information protected by HIPAA unless we have signed a Business Associate Agreement with you.

7. AI Receptionist notes

The AI Receptionist answers calls, answers common questions using information you approve, and books appointments. AI can make mistakes, so transcripts and summaries may contain errors. The AI Receptionist is not an emergency service. Callers with an emergency should hang up and dial 911.

8. Using the Site: what is not allowed

You agree not to:

  • break any law, or help anyone else break one;
  • send spam, malware, or harmful code, or try to access our systems or other people's data without permission;
  • interfere with or overload the Site, or bypass its security;
  • scrape or copy content or contact information in bulk, except through normal search engine indexing;
  • copy, resell, or pass off our designs, sample sites, copy, or demos as your own;
  • impersonate anyone or give false information;
  • enter real sensitive information (such as health, financial, or Social Security information) into our demos; or
  • use the Site, demos, or our AI tools to harass anyone, deceive callers, or create unlawful content.

We may suspend or block anyone who breaks these rules.

9. Demo sites

Our sample sites use fictional businesses, reviews, prices, and details to show what we can build. They are not offers from real businesses, and nothing on them is professional, medical, legal, or financial advice. The demo chat is scripted and does not store what you type. Demo results show how the tools work; they are not promises about results for your business.

10. Intellectual property

  • Our content. The Site, including its text, graphics, logos, sample sites, designs, code, and AI scripts, belongs to AZ AI Geeks or our licensors. "AZ AI Geeks" and our logo are our trademarks.
  • Limited permission. You may view and use the Site to learn about and buy our services.
  • Client work. Once your project is paid in full, you own the final design and content we create specifically for your website. We keep ownership of our own tools, templates, code libraries, and AI configurations, and you get an ongoing license to use any that are built into your site. Third-party items such as fonts, plugins, and the AI phone platform stay under their own licenses.
  • Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
  • Copyright complaints. If you believe content on the Site infringes your copyright, email hello@azaigeeks.com with the details listed in 17 U.S.C. § 512(c)(3).

11. Results, testimonials, and statistics

Our marketing describes goals and typical experiences. Results vary and depend on your market, offer, pricing, call volume, reputation, how quickly you follow up, and other things outside our control. Testimonials reflect individual clients' experiences and are not a promise that you will get the same results.

12. Third-party services

Our Site and services rely on other companies, such as hosting, phone and text providers, AI providers, calendars, Stripe, and ad platforms. We choose and set them up carefully but do not control them. Their outages, policy changes, or account decisions (for example, an ad platform suspending an account or a carrier blocking texts) are outside our control, and their own terms may apply to you.

13. Privacy

Our Privacy Policy explains how we collect and use personal information, including calls answered by AI Receptionists we run for clients.

14. Disclaimers

The Site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site or any service will be uninterrupted or error-free. Content on the Site is general information, not professional advice. Any warranties for paid services are only those in your Order Form or Client Service Agreement.

15. Limitation of liability

To the fullest extent the law allows:

  • we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities;
  • for use of the Site alone, our total liability is limited to $100; and
  • for paid services, our total liability is limited to the fees you paid us in the 3 months before the claim arose, unless your signed agreement says otherwise.

These limits do not reduce any refund or service credit you are owed under our guarantees, and they do not limit liability for fraud, gross negligence, willful misconduct, or anything else the law does not allow to be limited.

16. Indemnity

If you misuse the Site or our services, break these Terms, or violate someone else's rights (including callers' rights under call-recording or texting laws on your line), and that leads to a claim against us, you agree to defend and indemnify AZ AI Geeks and its owner, employees, and contractors against that claim, including reasonable attorneys' fees.

17. Disputes

  • Talk to us first. Before filing any claim, send a written description of the problem and the outcome you want to hello@azaigeeks.com. We will both try in good faith to resolve it within 30 days.
  • Optional mediation. If that doesn't work, either side may propose non-binding mediation in Maricopa County, Arizona, or by video, with costs shared equally.
  • Courts. Unresolved disputes will be decided only in the state or federal courts in Maricopa County, Arizona. Either side may bring an individual claim in small claims court if it qualifies.
  • Jury and class waiver. To the fullest extent the law allows, each side waives the right to a jury trial, and claims may be brought only individually, not as part of a class, collective, or representative action.
  • Time limit. Any claim must be filed within one year after it arose, unless the law requires a longer period.
  • Fees. In a lawsuit, the winning party may recover reasonable attorneys' fees and costs as allowed by A.R.S. § 12-341.01.

18. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules.

19. Changes to these Terms

We may update these Terms by posting a new version on this page and changing the effective date. Changes apply from then on and do not apply to disputes that arose earlier. Changes to a signed agreement require that agreement's own amendment process.

20. General

  • Entire agreement. These Terms, our Refund & Cancellation Policy, our Privacy Policy, and any signed Order Form or Client Service Agreement are the full agreement about their subjects.
  • Severability. If any part is found unenforceable, the rest stays in effect.
  • No waiver. Not enforcing a right right away does not waive it.
  • Assignment. You may not transfer these Terms without our consent. We may transfer them to a successor business, including a limited liability company we form to run AZ AI Geeks.
  • Electronic communications. You agree that electronic agreements, notices, and signatures satisfy any requirement that they be in writing.
  • Events beyond our control. We are not responsible for delays caused by events outside our reasonable control, such as outages at hosting, phone, or AI providers, internet failures, natural disasters, or government action.
